Tulane 50-50 Raffle
The Tulane 50-50 Raffle is a new chance for Tulane fans to contribute to the university and also take home some money for themselves. At select Tulane Athletic events, raffle tickets will be sold with proceeds going to the Green Wave Club. Fifty percent of the donated money will then be awarded to a lucky raffle winner. Raffle tickets will cost $5 for three, $10 for 10 and $20 for 40 tickets. To purchase raffle tickets, look for sellers at Gate B of Yulman Stadium or on the concourse of Avron B. Fogelman Arena in the Devlin Fieldhouse and multiple sections of Greer Field at Turchin Stadium.

Terms and Conditions
Please read these Terms and Conditions before participating Tulane Athletics Electronic 50/50 Raffle. By purchasing a raffle ticket, you represent that you meet all eligibility requirements to participate in the raffle and agree to be bound by these Terms and Conditions. This raffle is operated by Tulane Athletics, a department of the Administrators of the Tulane Education Fund d/b/a Tulane University (“Tulane”), a 501(c)(3) charitable organization organized under the laws of the State of Louisiana and located at 6823 St. Charles Avenue, New Orleans, Louisiana, 70118.
1. OVERVIEW: Raffle tickets will be available for sale before kickoff, tip off, or first pitch of the applicable game and remain available until the conclusion of the third quarter, halfway through the second half, or 6th inning of the applicable game. Tickets are sold at 2900 Ben Weiner Drive, New Orleans, Louisiana, 70118 (“Yulman Stadium”), 3000 Ben Weiner Dr, New Orleans, LA 70118 (“Turchin Stadium”), and 6811 Freret St, New Orleans, LA 70118 (“Devlin Fieldhouse”). For each raffle, one ticket will be randomly selected as the winning ticket. The winning ticket will be announced via the Public Address System and video boards at the applicable location and posted to the Tulane Athletic Department website (http://tulanegreenwave.com) within twenty-four (24) hours of conclusion of the event. The purchaser of the winning raffle ticket is eligible to receive fifty percent (50%) of the gross proceeds from the raffle tickets sales for the applicable raffle (the “Award”). Tulane Athletics will retain the remaining (50%) fifty percent of the gross proceeds to fund its charitable purposes, after deducting administrative fees and other costs at its sole discretion. Participation in the raffle is strictly limited to those persons meeting the eligibility requirements stated below. For each raffle, all transactions, participants, purchasers, claimants, and payees are subject to these Terms and Conditions, and to all applicable laws, rules and regulations, including without limitation any rules and regulations set forth by the Louisiana Office of Charitable Gaming, the New Orleans Bureau of Revenue, and the U.S. Treasury Department and Internal Revenue Service.
2. ELIGIBILITY: The Raffle is only open to legal residents of the fifty (50) United States and the District of Columbia, who are twenty-one (21) years of age or older as of the date of participation in the Raffle, and who are physically present in the state of Louisiana at the time the raffle ticket is purchased (each, a “Participant”). Employees, officers, directors, representatives, agents, volunteers and contractors of the Tulane University Athletic Department are not eligible to participate or receive an award.
3. HOW TO PARTICIPATE: Only those meeting the eligibility requirements set forth above and consenting to these Terms and Conditions may participate. Raffle tickets may be purchased from an authorized member of the raffle staff at Yulman Stadium, Turchin Stadium, or Devlin Fieldhouse. There is no limit to the number of raffle tickets a Participant may purchase for any one raffle. All ticket sales are final. Participant need not be present at Yulman Stadium, Turchin Stadium, or Devlin Fieldhouse to win the raffle. The Participant acknowledges and agrees that Tulane and any related entities are not liable for any lost, late, misdirected, incomplete, illegible, undelivered, or destroyed tickets regardless of the cause or person responsible including without limitation any problem or technical malfunction of any computer or other electronic device, software, electronic platform, payment system, internet connection, connectivity network, or server.
4. RAFFLE DRAWINGS: One raffle ticket number will be selected in a random drawing from all eligible tickets for the applicable raffle. Tickets from the raffle will not be eligible for or included in any subsequent raffle. The winning ticket will be selected at the beginning of the fourth quarter, halfway through the second half, or 7th inning of the applicable game. The winner is randomly selected by a raffle software system. The results are final.
5. HOW TO CLAIM AN AWARD: To claim the Award, the purchaser of the winning ticket, or person to whom the purchaser validly transferred the ticket consistent with the terms and conditions of Paragraph 8 (“Award Claimant”), must contact Tulane Athletics, present the winning ticket, provide all required identifications, and execute all required documents within thirty (30) days of the drawing. The Award Claimant must complete all components of the claims process within the thirty (30) day claims period. The Award Claimant may initiate the claims process by presenting the winning ticket to a Tulane Athletics officer at the Tulane Athletics business office. The Tulane Athletics business office is open Monday through Friday from 9:00 a.m. to 5:00 p.m., excluding holidays. The Tulane Athletics business office may be contacted at (504) 314-7211. Upon receiving a claim, Tulane Athletics will provide the Award Claimant with a W-9 and an Award-Acceptance Release Form. Award Claimant must provide a valid photo identification, a valid tax-payer identification number, and execute both the W-9 and Award-Acceptance Release Form. In the event the Participant does not, within thirty (30) days of the drawing for the applicable raffle: (a) claim the Award pursuant to the procedures set forth herein; (b) verify all eligibility requirements; (c) return an executed Award-Acceptance Release Form; (e) return an executed W-9 with a valid tax-payer identification number; and (f) provide valid photo identification, the Award will be irrevocably forfeited and will be retained in full by Tulane Athletics. Tulane has no obligation to contact any potential Award recipients. All awards will be delivered via check within thirty (30) days of the Award Claimant’s successful completion of all claim requirements set forth herein. For security and safety reasons, no cash payments will be made to any Award Claimant. Unclaimed Awards will be retained by Tulane Athletics for its charitable purposes and will not be included in the Award for any subsequent raffles.
6. ODDS: The odds of receiving an Award will be dependent on the total number of raffle tickets purchased for the applicable raffle.
7. TAXES: The U.S. Internal Revenue Service has taken the position that amounts paid for chance-based raffle tickets, lottery tickets, or similar programs are not gifts and, therefore, the price of a ticket to participate in this raffle does not qualify as a deductible charitable contribution. Award Claimant (and the purchaser of the winning ticket, if someone other than the Award Claimant) will be solely responsible for any and all federal, state, and local taxes, fees, and other charges. Federal and state law may require that a certain amount of the Award be withheld and/or that the amount of the Award be reported to the relevant government agencies. Tulane Athletics will comply fully with all withholding and reporting obligations.
8. TRANSFER OF RAFFLE TICKET: Persons who purchase a raffle ticket may opt to give away or transfer their Raffle ticket to other eligible persons free of charge, but in doing so the purchaser waives any claim he or she might otherwise have to any potential Award. A purchaser of any Raffle tickets may not re-sell a raffle ticket or give it away for the purpose of allowing another party to re-sell the raffle ticket. Any raffle ticket which has been resold shall be void and ineligible to be the winning ticket. All individuals who re-sell, purchase, or receive a raffle ticket in violation of these Terms and Conditions shall be ineligible to participate in the Raffle or receive an Award and may be disqualified from participation in future raffles.
9. PARTICIPANT’S GRANT OF LICENSE: By participating in the raffle or accepting an Award, each Participant grants to Tulane and Tulane Athletics a worldwide and perpetual license to use, publish, reproduce, create derivative works of, distribute, and publicly display any images or likenesses of the Participant taken or captured in connection with their participating in the Raffle, or claiming or receiving an Award (collectively, “Images”), in any form, media, or content which now or hereafter exists, for advertising, promotional, or any other commercial purposes as well as any non-commercial purposes. Each Participant waives any compensation for any use of such Images. Each Participant hereby releases and waives any claims, demands, damages, losses, liabilities, and causes of action arising from Tulane and Tulane Athletics’ uses of said Images, including, without limitation, any claims for defamation, libel, invasion of privacy, publicity, personality, or misappropriation or exploitation of the Participant’s name or likeness.
10. RELEASE OF LIABILITY AND INDEMNITY: By participating in the raffle, Participant, both on his or her own behalf and on behalf of his or her spouse, assigns, guardians, administrators, executors, and legal representatives hereby releases, waives, discharges, covenants not to sue, and agrees to protect, defend, indemnify and hold harmless Tulane and each of its agents, officers, administrators, directors and employees (collectively, the “Indemnified Parties”) from any claims, demands, actions, liabilities, losses, costs and expenses, including without limitation attorneys’ fees, arising out of or related to Participant’s participation in the raffle, acceptance of the Award, including, but not limited to, any claims related to (i) any injury to Participant (including without limitation bodily injury, physical injury, and death) or damage to Participant’s property that occurs in connection with participation in the raffle, or claiming and accepting an Award; (ii) any failure to report and pay taxes, fees or other charges; and (iii) the Participant’s acts or omissions and the acts or omissions of any other party with respect to the Participant’s receipt of the Award, or participation in the Raffle, regardless of whether any such claims are caused in whole or in part by the negligence of Indemnified Party.
11. DISPUTES AND GOVERNING LAW: The raffle shall be governed by the laws of the State of Louisiana without respect to its conflict of law provisions. Any claims regarding the raffle that are not released, must be brought in the State or Federal Courts in New Orleans, Louisiana, and Participant hereby consents to the personal jurisdiction of such courts for purposes of any such action. The raffle is void outside the United States and where prohibited by law. Each Participant agrees that: (i) any and all disputes, claims, and causes of action not waived arising out of or in connection with the raffle, or any award provided, shall be resolved individually, without resorting to any form of class action; (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this raffle, but in no event attorneys' fees; and (iii) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN NO EVENT SHALL Tulane OR ANY RELATED ENTITY BE LIABLE FOR DAMAGES THAT EXCEED THE VALUE OF THE AWARD AWARDED TO ANY INDIVIDUAL PARTICIPANT IN THE RAFFLE.
12. DISQUALIFICATION; CHANGES: Tulane reserves the right, at its sole discretion, to disqualify any individual that tampers or attempts to tamper with the raffle ticketing process or the operation of the raffle, sells or auctions their raffle ticket, purchases a raffle ticket from an unauthorized party, violates these Terms and Conditions, or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE IS A VIOLATION OF THESE TERMS AND CONDITIONS AND OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, TULANE RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE TO THE FULLEST EXTENT PERMITTED BY LAW.
13. SEVERABILITY: If any provision of this Terms and Conditions is ruled invalid in an arbitral or judicial proceeding, such finding shall not affect the validity of any other provision or this Terms and Conditions as a whole, which shall remain in full force and effect.
